     ประเภทของการประกันภัย

     ถ้าจะทำให้เข้าใจถึงธุรกิจประกันภัยในประเทศไทย ผมว่าน่าที่จะเริ่มจากการมองในภาพรวมก่อน เอาแบบง่ายสุด ก็คือ ธุรกิจประกันในบ้านเรานั้น เขาแบ่งหลักๆ เป็น การประกันชีวิต กับการประกันวินาศภัยครับ ซึ่งแต่ละประเภทมีความแตกต่างกันอย่างไรก็คงต้องดูกันที่ความหมายครับ

     โดยเริ่มจากความหมายก่อน คือตามประมวลกฎหมายแพ่งและพาณิชย์ ( ปพพ. ) มาตรา 869 นั้น ให้คำจำกัดความของคำว่า “ วินาศภัย “ ไว้ว่า ความเสียหายอย่างใดๆ บรรดาซึ่งจะพึงประเมินเป็นเงินได้ และ พรบ.ประกันวินาศภัย ปี 2535 มาตรา 4 ได้หมายรวมถึงความสูญเสียในสิทธิประโยชน์หรือรายได้ด้วย ดังนั้นการประกันวินาศภัย ถ้าพูดง่ายๆ ก็คือการประกันความเสียหายที่สามารถตีราคาเป็นเงินได้จริงๆ เช่น ทรัพย์สินที่ได้รับเสียหายไม่ว่าจะเป็นบ้านพัก รถยนต์ สินค้าหรือทรัพย์สินอื่นๆ , การบาดเจ็บจากการถูกรถชน ค่ายา ค่ารักษาพยาบาล การขาดประโยชน์เพราะทำงานไม่ได้ สิ่งเหล่านี้ล้วนตีราคาเป็นเงินได้ทั้งสิ้น ดังนั้นการประกันภัยในประเภทการประกันวินาศภัยจึงมีหลายชนิดเช่น ประกันอัคคีภัย ประกัยภัยรถยนต์ ประกันภัยสินค้าระหว่างเดินทาง ประกันการโจรกรรม แม้กระทั่งการประกันสำหรับผู้เล่นกอล์ฟ และ การประกันชนิดอื่นๆ

     ส่วนถ้าเป็นการประกันชีวิต ปพพ. มาตรา 889 บอกไว้ว่า คือสัญญาซึ่งการใช้เงินนั้นย่อมอาศัยความทรงชีพ หรือมรณะของบุคคลคนหนึ่ง คือพูดง่ายๆ ก็คือ บริษัทประกัน ( ผู้รับประกันชีวิต ) จะจ่ายเงินจำนวนหนึ่งให้แก่ลูกค้าผู้ที่ทำประกัน ( ผู้เอาประกันภัย ) ในกรณีที่ผู้เอาประกันชีวิตมีอายุอยู่จนถึงเวลาที่กำหนดไว้ หรือ จ่ายเงินจำนวนหนึ่งให้แก่ ผู้รับผลประโชน์ ( ตามที่ผู้เอาประกันได้ระบุไว้ในสัญญา) หรือผู้สืบสิทธ์ ของผู้เอาประกัน ในกรณีที่ผู้เอาประกันชีวิต ได้เสียชีวิตลงภายในเวลาที่กำหนด จะเห็นได้ว่าเมื่อพูดถึงเรื่องชีวิตนั้นเราไม่สามารถตีราคาเป็นเงินได้ ซึ่งต่างกับการประกันวินาศภัย ซึ่งสามารถตีราคาเป็นเงินได้แน่นอน
